This End User License Agreement (the "Agreement") is concluded between ARTISMEDIA Sp. z o.o. (the "Licensor") and the organization or person that installs or uses the Application on its Bitrix24 account (the "Licensee").
By installing or using the Application you accept this Agreement. If you do not agree, do not install or use the Application. If you accept on behalf of an organization, you confirm that you are authorised to bind it.
1. Definitions
1.1. Application — the Consent24 software provided as a cloud service for recording and documenting consent of natural persons to the processing of their personal data for purposes defined by the Licensee, for contacts, leads and companies of a Bitrix24 account, including updates and documentation.
1.2. Bitrix24 account — the Licensee's cloud Bitrix24 workspace on which the Application is installed.
1.3. Marketplace — the Bitrix24 Marketplace through which the Application is distributed.
1.4. Data subject — a natural person whose consent is requested or recorded with the Application (usually a client or prospect of the Licensee recorded as a contact, lead or company representative in the Bitrix24 account).
1.5. Purpose — a processing purpose defined by the Licensee in the Application, with a title and consent text in one or more languages and a version number. Consent text — the wording of a Purpose shown to Data subjects.
1.6. Consent journal — the record of events kept by the Application for each Bitrix24 account: consent requested, granted, withdrawn, re-consent due, erasure requested and record exported, with the data listed in the Privacy Policy. Recorded consent — one event "consent granted" for one Purpose of one Data subject.
1.7. Free plan — the plan under which the Application is installed and used free of charge, with the features and limits listed for it in Section 4.2.
1.8. Pro plan — the paid plan that removes the limits and adds the features marked "Pro" in Section 4.2, available during the Trial or under an active Subscription.
1.9. Trial — a one-time 14-day period of the Pro plan free of charge for a Bitrix24 account (Section 4.4).
1.10. Subscription — the Licensee's paid subscription to the Pro plan for one Bitrix24 account, billed monthly or yearly through Stripe (Section 4).
2. What the Application does
2.1. Purposes. A Bitrix24 administrator of the Licensee creates Purposes, starting from editable templates (marketing e-mails, newsletter, phone calls and text messages, profiling and personalised offers, sharing with partners) in English, Polish and German, and selects the legal basis of each Purpose for reference. A change of the title or Consent text creates a new version; earlier versions are kept.
2.2. Collecting consent. For a contact, lead or company the Application can (a) create a personal consent link that the Licensee sends to the Data subject, (b) send a confirmation e-mail with such a link from the Licensee's Bitrix24 CRM e-mail (double opt-in), (c) produce a printable consent form in English, Polish or German, the signed scan of which a user uploads, and (d) let a user record consent given by phone or in person with a note. On the consent page nothing is pre-selected; the Data subject confirms each Purpose separately.
2.3. Withdrawal. Every Data subject gets a personal page where they can see their consents and withdraw any of them with one click. Users can also record a withdrawal on the Data subject's request.
2.4. Consent journal. Each event is recorded in the Consent journal with its date and time, Purpose and version of the Consent text, method, and — depending on the method — the IP address and browser of the Data subject, the e-mail address to which the confirmation was sent, the user who recorded it and a note. Records are only appended, never changed; every record carries a cryptographic hash of the previous one so that later changes can be detected. A copy of each event, with its hash, is added as a comment to the timeline of the CRM card.
2.5. In the Bitrix24 account the Application adds a "Consents" tab to contacts, leads and companies; for each Purpose based on consent a text field "Consent: <Purpose>" with the value granted, withdrawn or expired (empty — no consent) in contacts, leads and companies, and a field "GDPR: erasure requested"; the automation triggers "consent granted", "consent withdrawn" and "re-consent needed"; the workflow robots "check consent" and "request consent by e-mail"; and the uninstall notification subscription. It writes to the Bitrix24 account only these fields, timeline comments, the e-mails described in Section 2.2(b) and the uploaded scans (as timeline attachments). It does not delete or anonymise CRM records.
2.6. Data subject requests. For a Data subject the Application produces a "Record of consent" (printable page and JSON file) with the Consent journal entries and the Consent texts concerned, and records that the Data subject requested erasure, withdrawing their consents. Erasure or anonymisation of CRM data itself is done by the Licensee with the tools of Bitrix24.
2.7. The specific set of features is determined by the current version of the Application and its description in the Marketplace. Which features are available in the Free plan and which only in the Pro plan is set out in Section 4.2.
3. License grant
3.1. The Licensor grants the Licensee a non-exclusive, non-transferable, worldwide, revocable license to use the Application on the Licensee's Bitrix24 account for its internal business purposes for as long as the Application is installed. Features of the Pro plan are available only during the Trial or while a Subscription is active (Section 4).
3.2. The number of Bitrix24 users who may use the Application is not limited by the Licensor; it is determined by the Licensee's Bitrix24 plan.
3.3. The Licensee may use Consent texts, consent forms, Records of consent and exports created with the Application without restriction, including providing them to Data subjects and supervisory authorities. The templates of Consent texts are licensed to the Licensee for use and adaptation in its own consent requests.
3.4. All intellectual property rights in the Application remain with the Licensor. The Licensee's data, Purposes, Consent texts and the Consent journal remain the Licensee's. No rights are granted except those expressly stated.
4. Plans, subscription and payment
4.1. Plans. The Application is free to install. It is offered in two plans: the Free plan, free of charge and without time limit, and the paid Pro plan. The plan applies to the whole Bitrix24 account: one Subscription covers one Bitrix24 account (identified by its installation ID, member_id) and all its users; the price does not depend on the number of users or Data subjects.
4.2. Features by plan:
| Feature | Free | Pro |
|---|---|---|
| Purposes based on consent | 1 | unlimited |
| Recorded consents per calendar month per Bitrix24 account | 100 | unlimited |
| Consent link and web consent page (EN/PL/DE), recording by a user, withdrawal page, withdrawals | yes | yes |
| "Consents" tab, CRM fields, automation triggers, Consent journal with timeline copies, CSV export, integrity check | yes | yes |
| Double opt-in e-mails from the CRM | no | yes |
| Printable consent forms and upload of signed scans | no | yes |
| Record of consent (print, JSON) and "erasure requested" | no | yes |
| Workflow robots | no | yes |
| Re-consent periods | no | yes |
Withdrawals are never limited. Consents that Data subjects confirm with links already sent and through their withdrawal page are always recorded, even above the monthly limit; the limit applies when users create new consent links or record consent themselves. The counter is reset on the first day of each calendar month (UTC) and is not reset by reinstalling the Application.
4.3. Prices. The price of the Pro plan per Bitrix24 account is €9 per month or €90 per year, exclusive of VAT; it is also shown in the Application and in the Marketplace listing. The price that applies to the Licensee is the price shown in the Application and on the Stripe payment page when the Subscription is started.
4.4. Trial. The Trial starts automatically when the Application is first installed or first opened on a Bitrix24 account and lasts 14 days. No payment card is required. The Trial is granted once per Bitrix24 account: reinstalling the Application does not start it again. When the Trial ends without a Subscription, the account moves to the Free plan automatically and nothing is charged. If the Licensee starts a Subscription during the Trial, the remaining Trial days are kept and the first charge is made when the Trial ends.
4.5. Who may subscribe. Only a Bitrix24 administrator of the Licensee can start, change or cancel a Subscription, from inside the Application. The administrator confirms that they are authorised to make the purchase on behalf of the Licensee.
4.6. Payment. The Licensor collects payments directly; payments are not made through the Marketplace. Payment is made on the Stripe Checkout page, which opens in a separate browser tab, and is processed by Stripe Payments Europe, Limited (Ireland) as payment processor. The Licensor never receives or stores payment card data.
4.7. Billing and renewal. The Subscription is billed in advance for each billing period (one month or one year) and renews automatically for the same period until it is cancelled.
4.8. Cancellation. The Licensee may cancel the Subscription at any time through "Manage subscription" in the Application (Stripe Customer Portal) or by e-mail to artismediaeu@gmail.com. Cancellation takes effect at the end of the current paid period; the Pro plan remains available until then, and no further charges are made.
4.9. Failed payment. If a renewal payment fails, the Pro plan remains available until the end of the paid period plus a grace period of 7 days. If payment is still not received, the account moves to the Free plan.
4.10. Uninstalling does not cancel the Subscription. The Licensee must cancel it in the Customer Portal before uninstalling, or by e-mail to artismediaeu@gmail.com, in which case the Licensor cancels it on request.
4.11. Price changes. The Licensor may change prices with at least 30 days' notice to the Bitrix24 administrator of the Licensee (in the Application or by e-mail). A new price applies from the next renewal after the notice period; the Licensee may cancel before that renewal.
4.12. VAT and invoices. Prices exclude VAT. VAT is calculated by Stripe Tax on the basis of the billing address and VAT ID provided at checkout: for business customers in the EU outside Poland with a valid VAT ID, no VAT is charged and the reverse-charge mechanism applies; for customers in Poland, 23% Polish VAT is charged; for consumers in the EU, the VAT of their country of residence is charged; for customers outside the EU, VAT or other taxes are applied according to the applicable rules. Invoices and receipts are issued through Stripe and are available in the Customer Portal.
4.13. Refunds are governed by the Consent24 Refund and Cancellation Policy (https://consent-eu.ai-automation-agency.biz/legal/refund), which forms part of this Agreement. Mandatory rights of consumers under applicable law are not affected.
4.14. Returning to the Free plan. When the Pro plan ends, the limits of the Free plan apply again. The Consent journal, fields and timeline comments are kept in full and all withdrawal pages keep working. New consent links and records are possible only for the first Purpose created; other Purposes remain visible and can still be withdrawn. Robots configured by the Licensee stop working and write a note to the workflow log; re-consent periods are no longer applied to new events.
5. Consent texts and legal compliance
5.1. The Licensee is the controller. The Licensee decides for which purposes it asks for consent, writes or adapts the Consent texts, decides whether consent is the appropriate legal basis, and is responsible for the lawfulness of its processing, including informing Data subjects under Articles 13 and 14 GDPR and honouring withdrawals.
5.2. Templates are not legal advice. The templates of Consent texts, the descriptions of legal bases and any hints in the Application are a starting point provided for convenience. They do not constitute legal advice and are not guaranteed to be suitable for the Licensee's processing, its jurisdiction or sector (for example rules on electronic marketing communications). The Licensee should have its Consent texts reviewed by its data protection officer or a lawyer.
5.3. Evidence. The Application documents the events described in Section 2.4. Whether the documented consent meets the requirements of the GDPR or other law in a particular case (for example that consent was freely given and informed) depends on facts outside the Application. Consent recorded by a user (Section 2.2(d)) and signed paper forms are documented as entered by the Licensee's users.
5.4. Acting on withdrawals. The Application records withdrawals, updates the CRM fields and runs the triggers. Stopping processing after a withdrawal — for example excluding the contact from mailings — is done by the Licensee's own settings and processes (segments, automation rules). The Licensee is responsible for using the CRM fields or triggers in its mailing and calling processes.
5.5. E-mails. Confirmation e-mails are sent from the Licensee's Bitrix24 CRM e-mail on behalf of the Licensee; the Licensee is responsible for their sending and for its mailbox settings.
6. Restrictions
The Licensee shall not: (a) copy, modify, decompile or reverse engineer the Application except as permitted by mandatory law; (b) resell, sublicense or provide the Application to third parties as a service; (c) circumvent security, access controls or plan limits; (d) record consent that was not given, backdate or falsify records, or otherwise use the Application to deceive Data subjects, authorities or third parties; (e) use the Application for unsolicited communications without a lawful basis; (f) interfere with the Application's operation or overload it.
7. Licensee's responsibilities
7.1. The Licensee is responsible for the data entered into its Bitrix24 account and into the Application and for having a lawful basis to process the personal data it contains.
7.2. The Licensee is responsible for the access rights it grants to its users in Bitrix24: any user who can open a contact, lead or company and the "Consents" tab can request and record consent and record withdrawals for it. Purposes, settings and the Subscription can be changed only by a Bitrix24 administrator.
7.3. The Licensee informs Data subjects that the consent page records the IP address and browser information as evidence of their confirmation, as part of its information under Articles 13 and 14 GDPR.
8. Bitrix24 account
The Application is intended for cloud Bitrix24 accounts. It may work with an on-premise Bitrix24 if the account and the Licensor's servers can reach each other over HTTPS; the Licensor is not responsible for network, certificate or firewall settings of an on-premise installation.
9. Personal data
Personal data is processed in accordance with the Consent24 Privacy Policy (https://consent-eu.ai-automation-agency.biz/legal/privacy). Its Section 11 (Data Processing Terms under Article 28 GDPR) forms an integral part of this Agreement.
10. Availability, support and updates
10.1. The Licensor makes reasonable efforts to keep the Application available but does not guarantee uninterrupted or error-free operation. Maintenance may cause short interruptions; during an interruption consent and withdrawal pages may be unavailable, and Data subjects can still contact the Licensee directly.
10.2. Support is provided by e-mail at artismediaeu@gmail.com and through the contact form at https://consent-eu.ai-automation-agency.biz/about, Monday–Friday, 9:00–18:00 CET, in English, Polish or Russian. We aim to respond within two business days. Support covers questions about the Application's features and diagnosing and fixing errors of the Application. It does not cover legal advice or setting up the Licensee's Bitrix24.
10.3. Updates are installed by the Licensor automatically and at no extra charge. Updates do not change existing records of the Consent journal. This Agreement applies to all updates.
10.4. The Application depends on Bitrix24 and its REST API; changes, limits or outages of Bitrix24 are outside the Licensor's control.
11. Warranty disclaimer
11.1. To the maximum extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11.2. The Application does not guarantee compliance of the Licensee with the GDPR or any other law, and the Licensor is not responsible for fines, claims or decisions of supervisory authorities resulting from the Licensee's processing, its Consent texts or its handling of withdrawals.
12. Limitation of liability
12.1. To the maximum extent permitted by law, the Licensor shall not be liable for indirect or consequential damages, lost profits, lost data or business interruption.
12.2. The Licensor's total liability under this Agreement is limited to EUR 100 or the amount paid by the Licensee for the Subscription in the preceding 12 months, whichever is greater.
12.3. Nothing in this Agreement limits liability for damage caused intentionally, liability of the Licensor as processor under Article 82 GDPR to the extent it cannot be limited, or any liability that cannot be limited under applicable law, including the rights of consumers.
13. Term and termination
13.1. This Agreement is effective from installation until the Application is uninstalled.
13.2. The Licensee may terminate at any time by uninstalling the Application. Uninstalling does not cancel a Subscription (Section 4.10).
13.3. Export before uninstalling. The Consent journal is stored by the Licensor (Privacy Policy, Section 5). The Licensee can export it at any time (CSV for the whole account, Record of consent per Data subject). After uninstallation the journal is kept for 30 days and then deleted; if the Application is reinstalled on the same Bitrix24 account within that period, the journal is available again. Consent and withdrawal links stop working immediately on uninstall. CRM fields and timeline comments (including the hashes of the records) remain in the Bitrix24 account.
13.4. The Licensor may suspend or terminate access for material breach of this Agreement, or discontinue the Application with at least 30 days' notice, during which the Licensee can export the Consent journal; in that case any Subscription is cancelled and no further payments are charged.
14. Changes
The Licensor may update this Agreement. The current version is published at https://consent-eu.ai-automation-agency.biz/legal/license. Material changes take effect no earlier than 30 days after publication; continued use after that date means acceptance. Changes to this Agreement do not by themselves make features of the Free plan payable and do not change the price of an active Subscription; prices change only under Section 4.11.
15. Governing law and disputes
15.1. This Agreement is governed by the laws of the Republic of Poland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
15.2. Disputes shall be resolved by the common court competent for the Licensor's registered office in Warsaw, unless mandatory law provides otherwise (in particular for consumers).
16. Miscellaneous
16.1. If any provision is held invalid, the remaining provisions remain in force.
16.2. This Agreement, together with the Privacy Policy and the Refund and Cancellation Policy, constitutes the entire agreement regarding the Application.
16.3. In case of discrepancies between language versions, the English version prevails.
